      Unless otherwise stated in writing, the following general terms and conditions shall apply to all quotations and contracts:        <br />
              <br />
       1) Our work and deliverables are payable in accordance with the progress of the contract.        <br />
       2) Our invoices are payable within fifteen days of the date of issue. After this period, interest will be charged at the rate of 16% a year, without warning or formal notice.        <br />
       In addition, any unpaid invoice will require the debtor to pay a penalty clause equal to 10% of the invoice amount, with a minimum of €150.        <br />
       3) Settlement of an invoice by draft will only be accepted by prior agreement.        <br />
       The issuance or acceptance of a bill of exchange or negotiable instrument will not result in novation, and in any event these remaining terms and conditions shall apply.        <br />
       4) Any fluctuation in the basic price of materials, wages, social laws, taxes and duties, and in general, any factor that may affect our price when the order is processed, may lead to a reassessment and re-invoicing in our favour.        <br />
       5) We are not responsible for any damage that may be incurred by third parties, either while or after undertaking the work.        <br />
       6) The goods we supply remain our property until payment in full of the relevant invoices.        <br />
       7) Our work and supplies may be interrupted in the event of non compliance with the terms and conditions listed above under 1 and 2.        <br />
       8) If a timescale has been given, it is not mandatory and any delay may not result in damages in favour of the contracting authority.        <br />
       9) Our warranty, where due, is limited to the replacement of defective parts to the exclusion of any other damages generally.        <br />
       This warranty expires, automatically, upon receipt of the goods or works.        <br />
       10) It is the contracting authority’s responsibility to provide us with the water and electricity connections required to undertake the work and to bear the cost of these connections and the consumption of water and electricity resulting from them.         <br />
       11) At the location where the work must be undertaken the contracting authority shall provide us with lavatories and a refectory, as specified in the new Act, and premises secure against all risks whatsoever that may endanger our supplies, tools, and the clothing of our workers. It will also insure against these risks with sufficient capital to cover them.        <br />
       12) If the contracting authority uses a third party to act in its place to receive our supplies and our work, it alone shall bear any resulting costs thereof.        <br />
       13) Pro rata sharing of costs such as the cleaning of a site, monitoring it or the rental of containers is not accepted without explicit agreement in advance prior to the start of the site work concerned.        <br />
       14) Any invoice for less than €50 shall be increased automatically by €10 for accounting expenses.       <br />
       15) The simple act of placing an order on us implies acceptance of our general terms and conditions and, where necessary, waiver by the other party of its own general and specific terms and conditions.        <br />
       16) Any e-mail must be confirmed by post or by fax in order to be taken into consideration or to become a contractual document.        <br />
       17) In the event of dispute, the courts of Mons shall have sole jurisdiction.
